Man Files Lawsuit Against Venetian Las Vegas and Its Security Guards

Las Vegas at NightRecently, a man who was shot in January 2021 at the Venetian Las Vegas during a confrontation at the casino sued the casino and its security guards for emotional distress and purported negligence.

The lawsuit was filed recently, and the man is seeking more than $50,000 in damages. According to the lawsuit, the security guards of the casino did not protect visitors when an armed man fired and wounded one man in the group, reports KLAS, which is a local TV station. Eric Aguilar, who is the wounded man, underwent multiple leg surgeries because of the shooting on January 18, 2021.

How the Incident Started

The incident started as a dispute in the Venetian’s Palazzo Casino where Eric Aguilar was celebrating his birthday with his friends. Someone who was in Aguilar’s group made a remark about a person sporting a San Francisco 49s shirt. The individual he commented on was with another group.

The lawsuit mentioned that without any warning, the shooter started verbally engaging Mr. Aguilar’s group and threatened to kill Mr. Aguilar and his pals, according to KLAS. The armed man walked away from the scene but stayed at the casino. Aguilar and other people in his group were asked to leave by the casino security officers, according to the lawsuit.

The lawsuit said that the guards neglected to ask Aguilar for a statement and failed to look for the armed man. Later, when Aguilar and his friends went outside of the casino, they came across the armed man and another man.

According to the police, Aguilar and those with him threw beer bottles at the armed man and the second man. They did so in self-defense against the gunman and his friend, the lawsuit says.

Injury to the Groin

The lawsuit says that Aguilar was shot in the groin. According to the police, he was able to take the gun away from the armed man and hit the man with it. Officers from the LVMPD (Las Vegas Metropolitan Police Department) who arrived at the scene initially thought that Eric Aguilar was the shooter since he was in possession of the gun, KLAS said. The lawsuit mentions that two officers pointed their guns at Aguilar.

Aguilar and a friend of his, as well as the gunman, were all charged with the altercation. The criminal trial for Aguilar, who has pleaded not guilty, is set to start on January 30. KLAS mentions that the gunman has been charged with assault with a dangerous weapon and other crimes involving weapons.

The Claims of Aguilar’s Attorneys

In a separate civil lawsuit, the attorneys of Aguilar claimed that the Venetian and its guards did not act properly. The lawsuit alleged that the Venetian defendants’ negligence and callous acts put Aguilar in danger for a third time, this time by failing to report the gunman and the incident that took place on the gaming floor to law enforcement at the time the incident occurred.

It was further disclosed that some Venetian employees gave the first treatment to Aguilar after he was shot before the arrival of EMTs. Aguilar was then taken to a hospital nearby, where his condition was initially critical.
